1. Introduction

1.1 The Degiorgigioielli.ch Site Terms and Conditions written on this webpage will govern your use of this Site. These Terms will apply in full and will affect your use of this Site. By using this Site, you have agreed to accept all of the terms and conditions written here. You must not use this Site if you do not agree to any of these Terms and Conditions on this Site.

2. Intellectual Property Rights.

2.1 Subject to these Terms, De Giorgi Gioielli and/or its licensors own all intellectual property rights and materials contained on this Site.

The consumer is granted a limited license solely for the purpose of viewing the materials contained on this Site.

2.2 It is prohibited to publish any material from this Site in any other medium.

2.3 It is prohibited to sell, sublicense, and/or otherwise market any material from this Site.

2.4 You may not publicly perform and/or display any material from this Site.

2.5 You may not use this Site in any manner that is or may be harmful to this Site.

2.6 You may not use this Site in any manner that violates applicable laws and regulations or in any manner that may cause harm to this Site or any person

3. Scope of application

3.1 Any sale on the Site constitutes a distance contract governed by the Consumer Code and Legislative Decree No. 70 of April 9, 2003, containing the regulation of electronic commerce.

3.2 The General Conditions of Sale apply to all sales made by the Seller on the Site. The terms indicated are to be understood as working days, thus excluding Saturdays, Sundays and national holidays.

3.3 The General Conditions of Sale may be modified at any time. Any amendments and/or new conditions will be in force from the time of their publication on the Site. You are therefore invited to access the Site regularly and consult the most up-to-date version of the General Terms and Conditions of Sale before making any purchase.

3.4 The applicable General Terms and Conditions of Sale are those in effect on the date you submit your purchase order.

3.5 You are responsible for carefully reading these General Terms and Conditions of Sale as well as all other information that the Seller provides on the Site.

3.6 The submission of the purchase order constitutes acceptance of these General Terms and Conditions of Sale.

4. Purchases on the Site

4.1 Purchases on the Sitemay take place upon registration with the Site
Is allowed to users who hold the quality of consumers. Pursuant to art. 3, I paragraph, lett. a) of the Consumer Code, it is recalled that the quality of consumer is the natural person acting for purposes unrelated to the entrepreneurial, commercial, professional or craft activity possibly carried out.

4.2 The Seller reserves the right to refuse or cancel orders that come:

from a user with whom the Seller has an ongoing legal dispute
from a user who has previously violated the General Conditions of Sale
from a user who has been involved in crimes
from a user who has issued false, incomplete or otherwise inaccurate identification data or who has not sent to the Seller, in a timely manner, the documents requested by it or who has sent it invalid documents.
5. Registration on the Site

5.1 To register to the Site You must fill out the appropriate form, entering the following data:

5.2 You agree to inform the Seller immediately if you suspect or become aware of any misuse or improper disclosure of your Site access credentials.

5.3 The user registered to the Site warrants that the personal information provided by him/her is complete and true and agrees to hold the Seller harmless and indemnified from any damage, indemnification obligation and/or penalty arising from and/or in any way connected with the violation by the user of the rules on registration to the Site or on the storage of registration credentials and/or the provision of false, incomplete or otherwise inaccurate personal data, without prejudice to the right of the Seller to proceed to disable the user's account.

5.4 To conclude a purchase contract on the Site, You shall complete an order form in electronic format and transmit it to the Seller, electronically, following the instructions that will appear from time to time on the Site. The contract is concluded when the order form reaches the Seller's server. Once the order form has been received, the Seller will send you an order confirmation containing: information on the characteristics of the purchase and an indication of the price to the e-mail address indicated.

6. Availability of the Products

6.1 The Products offered on the Site are limited in number. It may therefore happen, including due to the possibility that multiple users purchase the same Product at the same time and/or that the Product has been sold on another platform and the Site has not been updated in a timely manner that the Product ordered is no longer available after the transmission of the purchase order.

6.2 Alternatively, You may accept:

if reassortment is possible, an extension of the delivery period, offered by the Seller, with an indication of the new delivery period
if reassortment is not possible, the Seller will provide a different product of equivalent or higher value, subject to payment, in the latter case, of the difference, and subject to your express acceptance.

6.3 In the event that a refund is requested for the amount paid for the purchase of Products that later turned out to be unavailable, the Seller shall make the refund within a maximum period of 15 days.

6.4 In the event that the payment of the total amount due, consisting of the price of the Product, shipping charges, if any, and any other additional costs, as resulting from the order (Total Amount Due) has already been made, the Seller will make the refund of the Total Amount Due in accordance with the provisions of the article “Payment Method” below.

7. Information Sheet

7.1 Each Product is accompanied by an information page illustrating its main characteristics (Information Sheet). The images and descriptions on the Site reproduce as closely as possible the characteristics of the Products. The colors of the Products, however, may differ from the actual colors due to the settings of the computer systems or computers you use to view them. The Product images in the Information Sheet, moreover, may differ in size or in relation to any ancillary products. Such images should therefore be understood as indicative and within the tolerances of use.

8. Pricing

8.1 All prices of Products posted on the Site are inclusive of Value Added Tax.

8.2 The Seller reserves the right to change the price of the Products, at any time, without notice to you, provided that the price charged to you shall be the price shown on the Site at the time you place your order and that no account shall be taken of any changes (upward or downward) after the order has been placed.

8.3 Shipping charges, if any, shall be expressly and separately indicated on the order form before you proceed to transmit the same.

9. Purchase Orders

9.1 Seller will ship the Products only after receiving confirmation of payment authorization or upon credit of the Total Amount Due. Title to the Products will transfer to you upon shipment, which shall be deemed to be the time of delivery of the Product to the carrier. On the other hand, the risk of loss of or damage to the Products, due to causes not attributable to the Seller, shall be transferred to you when you, or a third party designated by you and other than the carrier, take physical possession of the Products.

10. Methods of Payment.

10.1 The following methods of payment are permitted on the Site:

10.2 The Seller accepts credit cards from the following circuits:

VISA
MasterCard (Cirrus Maestro)
They are, in each case, indicated in the footer of each page of the Site.

The charge will be made only after (i) the details of your payment card used for payment have been verified and (ii) the issuer of the payment card used by you has issued authorization for the charge.

Confidential payment card data (card number, cardholder, expiration date, security code) are encrypted and transmitted directly to the payment processor without passing through the servers the Seller uses. The Seller, therefore, never has access to and does not store, even if you choose to store such data on the Site, the data of your payment card used to pay for the Products.

The charge will be made at the time the order is transmitted.

10.3 You can also make purchases on the Site using the PayPal/Twint payment solution. If you choose PayPal/Twint as your payment method, you will be redirected to the PayPal/Twint site where you will make the payment according to the procedure provided for and governed by PayPal/Twint under the terms and conditions of the contract agreed between you and PayPal/Twint The data you enter on the PayPal/Twint site will be processed directly by it and will not be transmitted or shared with the Seller. The Seller is therefore not able to know and does not store in any way the data of the payment card linked to your PayPal/Twint account or the data of any other payment instrument connected with that account.

In the case of payment through PayPal/Twint, the Total Amount Due to You will be debited by PayPal/Twint at the same time as the conclusion of the contract through the Site. In case of termination of the purchase contract and in any other case of reimbursement, for any reason, the amount of reimbursement due to You will be credited to the PayPal/Twint account of the same. The timing of crediting to the payment instrument linked to such account depends solely on PayPal/Twint and the banking system. Once the crediting order has been arranged in favor of such account, Seller shall not be held liable for any delay or omission in crediting the refund amount, to dispute which you should contact PayPal/Twint directly. Any refund to be made pursuant to these Terms and Conditions of Sale shall be credited to Your PayPal/Twint account.

10.4 In the event that You choose bank transfer as a method of payment, the Seller, upon receipt of Your order, will notify You by email of the bank details and the deadline for making the transfer. The email may contain a request to email the receipt of the bank transfer made or the confirmation of the making of the same.

In the case of payment by bank transfer, the delivery time for the Product indicated in the Product Sheet and/or on the Site, will commence from the date of receipt of the transfer by the Seller and not from the date of transmission of the order, as is the case if You choose other methods of payment.

Unless otherwise agreed, Services will be rendered only after receipt by bank transfer of the Total Amount Due.

You are requested to indicate in the reason for the transfer the following data:

the order reference number.
From the placing of the order You must arrange for payment within 2 business days. If you fail to do so, the Seller reserves the right to cancel your order within the next 2 business days.

11. Delivery of Products

11.1 There are no limitations on delivery except in the cases that may be indicated on the Site and/or in the Product Sheet.

11.2 Delivery is chargeable except for promotions decided by the Seller and communicated on the Site or by email.

11.3 From the date of placing the order, the Products will be delivered within 30 days and, in any event, within thirty days from the date of conclusion of the contract.

11.4 It is your responsibility to verify the condition of the delivered Product. Notwithstanding the fact that the risk of loss or damage of the Product, due to causes not attributable to the Seller is transferred when you, or a third party designated by you and other than the carrier, materially comes into possession of the Product, the Seller recommends that you verify the number of Products received and that the packaging is intact, not damaged, nor wet or otherwise altered, including in the sealing materials and you are invited, in your interest, to indicate on the transport document of the carrier, any anomalies, accepting the package with reserve. In the event that the package shows obvious signs of tampering or alteration, it is appropriate to give prompt notice to Seller. This is without prejudice, in any case, to the application of the rules on the right of withdrawal (if any for the Product) and the legal guarantee of conformity.

11.5 For shipments outside Switzerland and Liechtenstein, you will be responsible for paying customs duties and related customs clearance fees.

12. Right of Withdrawal

12.1 In the event of a purchase on the Site, unless otherwise indicated, You do not have the right of withdrawal. In fact, custom-made or clearly customized goods are sold on the Site.

12.2 Only in case of receipt of damaged Goods contained in an undamaged package, you may avail yourself of the right of withdrawal.

12.3 You are responsible for the direct costs of returning the Products as well as the responsibility for the transportation of the Products.

12.4 If You withdraw from the contract, the Seller will proceed to refund the Total Amount Due, including delivery costs, if applicable, without undue delay and in any event no later than 14 calendar days from the day on which the Seller was informed of Your decision to withdraw from the contract. The refund will be made using the same payment instrument used for the initial transaction. In the event that you have returned the Products using a carrier of your choice and at your own expense, the Seller may suspend the refund until you have received the Products or until you have demonstrated that you have returned the Products, whichever is earlier.

13. Applicable law and place of jurisdiction; out-of-court settlement of disputes - Alternative Dispute Resolution/Online Dispute Resolution

13.1 Purchase contracts concluded through the Site are governed by Swiss law.

13.2 Please note that in the case of a consumer user, the Swiss courts shall have jurisdiction over any dispute relating to the application, performance and interpretation of this document.

13.3 In the event that the consumer has submitted a complaint directly to the Seller, as a result of which it has not, however, been possible to resolve the dispute thus arising, the Seller will provide information regarding the body or bodies of https://www.swissarbitration.org for the out-of-court settlement of disputes relating to obligations arising from a contract concluded under these General Terms and Conditions of Sale, stating whether or not it intends to use such bodies to resolve the dispute.
